Investigating the critical success factors [CSFs] of claims management in the construction contracts

Abstract

Günümüzde taraflar arasında imzalanan sözleşme ile başlayan inşaat projeleri yapısı gereğiyle karmaşıktır. Proje özellikleri ve sahip olduğu çoklu yapı sebebiyle bu sözleşmelerin yönetimi proje başarısında oldukça önemlidir. Başarılı bir proje yönetimi için taraflar arasında yaşanan anlaşmazlıkların proje süresini, maliyetini ve kalitesini etkilemeyecek en uygun ve en hızlı şekilde çözümü esastır. Bu çalışmada gün geçtikçe büyümekte olan inşaat projeleri için imzalanan sözleşmelerdeki hak talebi yönetiminde etkin olan kritik başarı faktörlerini tespit etmek amaçlanmıştır. Bu amaç doğrultusunda öncelikli olarak titiz bir literatür taraması yapılmıştır. Tarama sonucunda elde edilen veriler, piyasa uzmanları ile beraber değerlendirilmiştir. Değerlendirme sonucunda tespit edilen başarı faktörlerinin hak talebi yönetimi için önemini ve hak talebi yönetiminin başarısına etkisini belirlemek amacıyla kapsamlı bir anket düzenlenmiştir. İnşaat sektöründe dünya çapındaki payı giderek artmakta olan Türk inşaat firmalarının çalışanları üzerinde uygulanan anketin sonuçları SPSS 25 de faktör analizi yapılarak değerlendirilmiştir. Değerlendirme sonucunda elde edilen veriler neticesinde belirlenen faktörlerden başarıya en çok etki edenleri tespit edilmiştir. Aynı zamanda bu kritik başarı faktörleri kapsamları doğrultusunda gruplandırılmıştır. Eş zamanlı olarak katılımcılara dair yaş ve deneyim gibi tespitler de gerçekleştirilerek çalışma desteklenmiştir. Çalışmanın sonucunda elde edilen verilerin inşaat sözleşmelerindeki hak talebi yönetimi uygulamalarında dikkate alınarak uygulanmasının, projelerdeki zaman ve maliyet kayıplarının önüne geçeceği ve bu sayede projelerin başarısının artacağı öngörülmektedir.Construction projects that start with a contract signed between the parties are complex due to their nature. Because of project's peculiarities and complex structure, operation of these contracts is crucial to the project's success. It is crucial for effective project management that conflicts between stakeholders are settled quickly and appropriately without affecting the project's scope, budget or quality. The goal of this working is to assign the crucial achievement elements for claim management in contracts signed for construction projects, which are expanding daily. For this purpose, first of all, a meticulous literature review was conducted. The data obtained as a result of the scanning were evaluated together with the market experts. A comprehensive survey was conducted to determine the importance of the success criteria determined as a result of the evaluation and their effect on the damage management success. The conclusions of questionnaire applied to the employees of Turkish construction companies, whose share in the construction industry is increasing worldwide, were evaluated by factor analysis in SPSS 25. As a result of the data obtained as a result of the evaluation, the most influential factors on success were determined. At the same time, these critical success factors are grouped according to their scope. Simultaneously, the study was supported by making determinations such as the characteristics of the participants. The application of the information gleaned from the study, while taking into account the claim management procedures in building contracts, is expected to boost project success by preventing time and expense overruns.
