Emlak müşavirliği modeli

Abstract

Tapu Sicil Müdürlüklerinin, Medeni Kanunun öngördüğü tap^ «Sicilini- -* yansıtması konusunda yaşanılan sıkıntıların giderilebilmesi için Emlak Müşavirliği modeli önerilmiştir. Bu model için Avustralya'nın Victoria Eyaleti'ndeki ve Amerika Birleşik Devletlerindeki emlak müşavirliği mevzuatı incelenmiş ve Ülkemizde uygulanması uygun olacağı düşünülen bir model çalışması yapılmıştır. Tapu işlemleri yapmak, emlak beyan değeri belirlemek, bilirkişilik ve danışmanlık yapmak, kiralama ve komisyonculuk yapmak, Emlak Müşavirlerinin görevleri olarak düşünülmüştür. Emlak müşavirlerine devredilen görevler ve verilen yetkilerden dolayı vatandaş, ilgili memur, Tapu ve Kadastro Genel Müdürlüğü ve Devlet için kazanımlar belirlenmiştir.Anahtar Kelimeler; Emlak Müşavirliği, Tapu, Kiralama, Komisyonculuk.There are some difficulties which are to be faced by the directorate of land* Registary. These problems arise from reflecting land records whose manipulations are given as the main duty to the directorates by the acting civil law. To overcome these problems a Real Estate Consultancy Agent model is advised. For this, the laws in Avustralia's Victoria state and United state of America related to the real estate agency was investigated and a model which is thought to be suitable for application in our country was studied. In this model, carrying out Land records work, assesment of declaration of the real estates, doing consultancy, renting and agency are thought to be main duites of the real estate consultants. Considenable gains are expected in the case of application of this model savings at office works and at citizen's struggle for following the procedures at the directorates are some examples.
